mCards Inc., its affiliates and third party service providers (“mCards” or “we”) may need to provide you with certain documents, notices, agreements, statements, disclosures, and other records (“Communications”) in connection with the services that we provide to you (“mCards Services”). By agreeing to this E-SIGN Consent Agreement, you confirm your ability and consent to receive Communications electronically from mCards, rather than in paper form, and to the use of electronic signatures in connection with these Communications (“Consent”).
ELECTRONIC DELIVERY OF COMMUNICATIONS
Under this Consent, mCards may provide all Communications electronically by e-mail. We encourage you to save or print the Communications we provide to you electronically for future reference. You further agree that your computer or mobile device satisfies the system requirements specified below and that you have provided us with your current email address, not someone else’s, to which we may send electronic Communications to you. If you do not consent to receiving Communications or transacting via electronic records or signatures, you should not use mCards Services.
SYSTEM REQUIREMENTS
To access and retain the electronic Communications, you must have: (1) a personal computer or other device capable of accessing the Internet; (2) internet access; (3) a valid email address; (4) a widelyused, recent-generation web browser (for example, Chrome or Firefox); (5) a current version of a program that accurately reads and displays PDF files (such as Adobe Reader 8 or above); (6) a printer, hard drive or other storage capability. If you access our website and any consents or disclosures electronically via a mobile device (such as a smartphone, tablet, and the like), in addition to the above requirements you must be able to print and save Communications and receive text messages. If you do not have these capabilities on your mobile device, please access our website through a device that provides these capabilities. Your access to our site verifies that your ability to meet the requirements listed above.
PAPER DELIVERY OF COMMUNICATIONS
You have the right to receive Communications in paper form. To request a paper copy of any Communication, please contact us at suport@mcards.com. You will not be charged a fee for paper copies. Requesting a paper copy of any Communication will not be treated as withdrawal of your consent to receive electronic Communications.
WITHDRAWAL OF CONSENT TO ELECTRONIC COMMUNICATIONS
You may withdraw your Consent by contacting us at support@mcards.com. Any withdrawal of your Consent will be effective after a reasonable period of time for processing your request, and mCards will confirm your withdrawal of Consent and its effective date in writing (either electronically or in paper form). The legal effectiveness, validity and/or enforceability of Communications we sent prior to withdrawal will not be affected. If you withdraw your consent, mCards may restrict or terminate your access to mCards Services.
UPDATING YOUR E-MAIL ADDRESS
You agree to maintain a valid e-mail address and mobile phone number, promptly notify us of any changes to your e-mail address or mobile phone number, and update your contact information in your mCards account.
ACCEPTANCE
By checking the box to accept this E-SIGN Consent Agreement, you certify that you understand the system requirements described above, that you have demonstrated your ability to receive, retain, and view electronic Communications, and that you consent to the electronic delivery of all Communications. If you do not provide your Consent, or if you withdraw your consent, mCards may restrict or terminate your access to mCards Services.
