E-Sign Agreement

E-SIGN Consent Agreement

mCards Inc., its affiliates and third-party service providers (“mCards” or “we”) may need to provide you with certain documents, notices, agreements, statements, disclosures, and other records (“Communications”) in connection with the services that we provide to you (“mCards Services”). By agreeing to this E-SIGN Consent Agreement, you confirm your ability and consent to receive Communications electronically from mCards, rather than in paper form, and to the use of electronic signatures in connection with these Communications (“Consent”).

Scope

By consenting to this E-SIGN Consent Agreement, you agree to receive electronically all communications, disclosures, notices, records, and agreements related to your use of the mCards Services, mCards mobile application (the “mCards App”), any payment card provided to you in connection with the mCards Services (each, an “mCard”), and any associated services, including those governed by the Cardholder Agreement and Mobile App Terms and Conditions. All such Communications are provided exclusively in electronic form as a condition of accessing and using the mCards App and related services.

Electronic Delivery of Communications

Under this E-SIGN Consent Agreement, mCards will provide all Communications electronically through the mCards App, mCards website, by email, via text message (SMS), push notifications, and other electronic means or by making such Communications available for electronic review and retention, using the contact information you have provided. All Communications are provided exclusively in electronic form. mCards does not provide Communications in paper format, and no paper delivery option is available, unless we tell you otherwise. We encourage you to save the Communications we provide to you electronically for future reference.

 

You further agree that your computer or mobile device satisfies the system requirements specified below and that you have provided us with your current email address, not someone else’s, to which we may send electronic Communications to you. You are responsible for maintaining access to the mCards App, a valid email address, a valid mobile telephone number, and the hardware and software required to receive and retain electronic Communications.

 

If you do not consent to receiving Communications via electronic records and electronic signatures, you will not be able to activate or use your mCard, access the mCards App, or use mCards Services. Because the mCards App and mCard are provided through electronic means, your Consent to electronic delivery is a condition of activation and continued use.

All Communications provided under this E-SIGN Consent Agreement relate to your use of mCards Services and are not marketing communications, which are governed by separate consents where required.

Hardware and Software Requirements

To access and retain the electronic Communications, you must meet certain software, hardware, and other technical requirements, as described in this section. This includes the requirement to have or have access to:

  1. an up-to-date smartphone or mobile device capable of running the mCards App;

  2. the mCards App, available for download through the Apple App Store or Google Play Store, updated to the current version;

  3. internet access through a mobile data plan or Wi-Fi connection;

  4. a valid, active email address and a mobile telephone number capable of receiving text messages;

  5. software or functionality on your mobile device capable of viewing and retaining electronic documents, including PDF files;

  6. sufficient electronic storage capability on your mobile device or through cloud-based storage accessible to you to retain electronic Communications.

 

If our hardware or software requirements change, and that change creates a material risk that you would not be able to access or retain information, we will send you notice of the revised requirements. Continuing to access information electronically after receiving notice of the change reaffirms your Consent.

 

You will have the right to withdraw Consent. However, because the mCards App is accessible only through a mobile device that enables you to receive, view, download, and retain electronic Communications through your mobile device, if you withdraw Consent, your account will be closed/service will be terminated. mCards does not provide access to the mCards App through a web browser or desktop computer and does not require you to print Communications as a condition of access or use.

 

Certain Communications, disclosures, or informational materials may also be made available electronically through mCards’ website. Accessing such materials does not require use of the mCards App and does not change the mobile-only nature of the App. All such materials are provided electronically and are subject to this E-SIGN Consent Agreement.

 

By accessing the mCards App and providing your Consent, you confirm that you have the hardware, software, and mobile access capabilities described above and that you are able to receive and retain electronic Communications.

No Paper Delivery

We recommend you print or download Communications. All Communications are provided exclusively in electronic form. mCards does not provide Communications in paper format, and no paper delivery option is available. You will not receive paper copies of any Communications. Your Consent to electronic delivery is required to activate and use your mCard and to access the mCards App and related services. If you want a paper copy of documents provided electronically, you can write to us at Suite 2300, 1000 Main Street, Houston, Texas 77002. We will charge fees in the amount of $10 for paper copies, to the extent permitted under applicable law.

Withdrawal of Consent of Electronic Communications

You may withdraw your Consent by contacting us at support@mcards.com. Any withdrawal of your Consent will be effective after a reasonable period of time for processing your request, and mCards will confirm your withdrawal of Consent and its effective date electronically. The legal effectiveness, validity and/or enforceability of Communications we sent prior to withdrawal will not be affected.

 

Because the mCards App and mCard are provided exclusively through electronic means, withdrawal of your Consent will result in your account being closed but you will still have an obligation to pay any outstanding balance. You will be unable to activate or continue using your mCard and from accessing the mCards App and mCards Services. mCards does not offer paper delivery of Communications as an alternative.

 

Prior to withdrawal of your Consent becoming effective, mCards may provide final Communications related to account closure, outstanding obligations, or required disclosures electronically, including by email or text message, to ensure you receive all information necessary to complete the closure of your account.

Updating Your Information

You agree to maintain accurate customer information and to promptly notify us of any changes by updating your contact information through the mCards App. Certain information, including the unique mobile phone number associated with your mCards App account and used to deliver SMS communications to you, verify your identity, and issue your mCard (“Authorized Phone Number”), is associated with your individual user profile created within the mCards App (“Account Identity”) and mCard and cannot be updated directly through the mCards App.

 

If you need to change your Authorized Phone Number, you must contact mCards support directly at support@mcards.com. mCards may require additional verification before updating or re-associating an Authorized Phone Number in order to protect the security and integrity of your Account Identity and mCard.

Acceptance

By checking the box to accept this E-SIGN Consent Agreement, you certify that you understand the system requirements described above, that you have demonstrated your ability to receive, retain, and view electronic Communications, and that you consent to the electronic delivery of all Communications.
